MOSCOW, February 12 – RIA Novosti. The bill, which gives debtors the right to maintain a monthly income not lower than the subsistence level, will create additional difficulties for credit institutions, RBC reports with reference to the commentary of the Association of Russian Banks (ADB).
The organization believes that such an approach will force banks to take into account additional risks when calculating interest rates on loans. “Such an additional measure of support may lead to an increase in the cost of credit products for such persons in connection with a reduction in the sources of loan repayment,” – said in a statement.
In addition, it will be almost impossible to collect a debt from citizens whose income does not exceed the subsistence level, said Sergey Klimenko, head of the ADB's legal department.
The bill on the right of debtors to an inviolable income in the amount of a living wage was submitted to the State Duma on February 11. The authors of the project are the vice-speaker of the Federation Council Andrey Turchak, senators Andrey Klishas, Inna Svyatenko, Elena Bibikova, Maria Lvova-Belova. The initiative implies that the debtor will have the right to apply to the department of bailiffs, in which the enforcement proceedings are taking place, with a statement that the monthly income is not lower than the subsistence level in Russia as a whole. At the same time, the bank or other credit organization will not be able to collect the income specified in the decision of the bailiff.
