A judge cannot be punished for a point of view, even if it is erroneous, said the deputy chairman of the Supreme Court of the Russian Federation, chairman of the disciplinary board Sergei Rudakov. “A judge cannot be punished for the point of view he expressed during the administration of justice, even if this point of view is erroneous,” he said at a meeting of judges of courts of general jurisdiction and arbitration courts of Russia.
According to him, this is the basis of judicial immunity. Rudakov recalled that a judicial error in itself is not a disciplinary offense, mistakes are common to everyone.
“You can only deprive them of powers if mistakes and violations are gross and systematic in order to protect the participants in the process in the future,” he added.
