The State Duma adopted a law on temporary certificates for stateless persons

MOSCOW, Feb 9 – RIA Novosti. At a plenary session on Tuesday, the State Duma adopted a law on the issuance of temporary identity cards to stateless persons in the Russian Federation.

The draft law was submitted to the State Duma by the Russian government. As specified, now the legislation of the Russian Federation does not provide for a document proving the identity of a stateless person after his identity has been established.

The law provides that a temporary identity card of a stateless person in the Russian Federation is issued on the basis of a conclusion on establishing the identity of such a person and certifies the identity of its owner in the Russian Federation. According to the law, stateless persons who have a temporary identity card will be able to work without obtaining permits.

At the same time, the law includes provisions clarifying the grounds for the termination of detention in a special institution of stateless persons subject to administrative expulsion from the Russian Federation, deportation or readmission, in the event of cancellation of the relevant decisions, termination of the readmission procedure, as well as recognition of persons as refugees or granting them temporary asylum for the territory of the Russian Federation.

The law also provides for registration at the place of stay of persons with a temporary certificate after seven working days from the date of receipt of the document. Since the issuance of a temporary identity card gives a stateless person the opportunity to stay in the Russian Federation, the law provides for the suspension of decisions previously made in relation to him not to allow him to enter Russia or decisions on the undesirability of stay or residence in the Russian Federation.

The temporary certificate will be issued for 10 years. In the event of the expiration of the temporary certificate, the change of the last name, first name, patronymic by a stateless person, information about the date and place of birth, or the unsuitability of the temporary certificate for further use due to wear, damage or other reasons, detection of an inaccuracy or error in the records made in the temporary certificate the issued temporary certificate is subject to replacement.

No later than 10 working days before the expiration of its validity period, a stateless person will be obliged to apply to the territorial body of the Ministry of Internal Affairs of Russia with an application to replace the temporary certificate, and if there are conditions under which the temporary certificate must be replaced, within 30 days from the date of their occurrence …
